The appellant (wife) is seeking a divorce from her husband, alleging cruelty and desertion. 

The marital life was not happy from the start and the parties have been living separately since 2005. 

The husband argues that the wife could not adjust to living in a rural area and took a conscious decision to break the marital tie permanently. The wife filed several complaints against the husband with various authorities and wrote letters with the intention of destroying his career. 

The court finds that the wife's conduct towards the husband amounts to cruelty and allows the appeal for divorce. 

The court also rejected the argument that the failure of the authorities to take action on the wife's complaints renders them meaningless and emphasized that the impact of the conduct on the complaining spouse in the context of their standard of living is relevant to determining cruelty.

अपीलकर्ता (पत्नी) क्रूरता और परित्याग का आरोप लगाते हुए अपने पति से तलाक की मांग कर रही है।

वैवाहिक जीवन शुरू से ही सुखी नहीं था और पक्षकार 2005 से अलग-अलग रह रहे हैं।

पति का तर्क है कि पत्नी एक ग्रामीण क्षेत्र में रहने के लिए समायोजित नहीं हो सकी और वैवाहिक बंधन को स्थायी रूप से तोड़ने का एक सचेत निर्णय लिया। पत्नी ने पति के खिलाफ विभिन्न अधिकारियों के पास कई शिकायतें दर्ज कराईं और उसके करियर को नष्ट करने के इरादे से पत्र लिखे।

अदालत ने पाया कि पति के प्रति पत्नी का आचरण क्रूरता की श्रेणी में आता है और तलाक की अपील की अनुमति देता है।

अदालत ने इस तर्क को भी खारिज कर दिया कि पत्नी की शिकायतों पर कार्रवाई करने में अधिकारियों की विफलता उन्हें अर्थहीन बना देती है और इस बात पर जोर दिया कि शिकायत करने वाले पति या पत्नी पर उनके जीवन स्तर के संदर्भ में आचरण का प्रभाव क्रूरता का निर्धारण करने के लिए प्रासंगिक है।
