फैमिली कोर्ट द्वारा सहमति से पारित किसी भी आदेश में अपील सुनवाई योग्य नहीं

झारखंड हाईकोर्ट ने हाल ही में कहा कि फैमिली कोर्ट एक्ट, 1984 की धारा 19(2), सिविल प्रक्रिया संहिता की धारा 96(3) के तहत प्रावधान के समान है, जो पक्षकारों की सहमति से पारित डिक्री की अपील को प्रतिबंधित करती है। पीठ ने कहा की पक्षकारों की सहमति से फैमिली कोर्ट द्वारा पारित किसी भी आदेश में कोई अपील नहीं होगी।

उन्होंने कहा ऐसी अपील सुनवाई योग्य नहीं है और खारिज कर दिया। हिंदू विवाह अधिनियम, 1955 की धारा 13बी के तहत दी गई तलाक की डिक्री को पत्नी ने ये कहकर याचिका दायर की थी की उसे आपसी सहमति से विवाह की डिक्री के लिए याचिका पर हस्ताक्षर करने की धमकी दी गई थी। मूल मुकदमे के अनुसार, यह दर्ज किया गया कि आपसी सहमति से तलाक के लिए एक याचिका दोनों पक्षों के हस्ताक्षर के साथ दायर की गई थी।

याचिका के आधार पर फैमिली कोर्ट के जज ने दर्ज किया कि दोनों पक्षों की स्वतंत्र सहमति सुनिश्चित करने के लिए दोनों पक्षों के बयान दर्ज किए गए और उस पर उनके हस्ताक्षर किए गए हैं।

बेंच ने पुष्पा देवी भगत बनाम राजेंद्र सिंह के मामले का उल्लेख किया, जहां सुप्रीम कोर्ट ने सिविल प्रक्रिया संहिता की धारा 96 और सिविल प्रक्रिया संहिता के आदेश XXIII नियम 3 और नियम 3-ए के प्रावधान का हवाला देते हुए कहा था कि इस तरह की सहमति डिक्री से बचने के लिए एक सहमति डिक्री के लिए एक पक्षकार के लिए उपलब्ध एकमात्र उपाय उस अदालत से संपर्क करना है जिसने समझौता दर्ज किया और इसके संदर्भ में एक डिक्री बनाई।

हाईकोर्ट ने कहा, “फैमिली कोर्ट एक्ट, 1984 की उप-धारा (2) से धारा 19 के तहत प्रावधान सिविल प्रक्रिया संहिता की उप-धारा (3) से धारा 96 के प्रावधान के समान है क्योंकि, पक्षकारों की सहमति से फैमिली कोर्ट द्वारा पारित किसी भी आदेश में कोई भी अपील नहीं होगी।”
