The principle that the conditions for granting bail should not be so burdensome that they effectively amount to a refusal of bail. 

The court is referencing a previous case, Sandeep Jain Vs. 

National Capital Territory of Delhi (2000), in which the court held that imposing a large monetary condition on an accused at the FIR stage is not appropriate and can lead to the accused remaining in jail for an extended period. 

In the present case, the court is stating that the High Court imposed excessive conditions for bail on the appellant, which in practice, has acted as a refusal of bail. 

The court is emphasizing that the conditions for bail should not be so onerous that they prevent an accused from being released on bail.

यह परिच्छेद इस सिद्धांत पर चर्चा कर रहा है कि जमानत देने की शर्तें इतनी बोझिल नहीं होनी चाहिए कि वे प्रभावी रूप से जमानत से इनकार करने के बराबर हों। 

अदालत पिछले एक मामले का हवाला दे रही है, संदीप जैन बनाम। राष्ट्रीय राजधानी क्षेत्र दिल्ली (2000), जिसमें अदालत ने कहा कि प्राथमिकी चरण में एक अभियुक्त पर एक बड़ी मौद्रिक शर्त लागू करना उचित नहीं है और अभियुक्त को एक विस्तारित 

अवधि के लिए जेल में रहना पड़ सकता है। वर्तमान मामले में, अदालत कह रही है कि उच्च न्यायालय ने अपीलकर्ता पर ज़मानत के लिए अत्यधिक शर्तें लगाईं, जो व्यवहार में ज़मानत से इनकार के रूप में काम किया है। 

अदालत इस बात पर जोर दे रही है कि जमानत के लिए शर्तें इतनी कठिन नहीं होनी चाहिए कि वे किसी आरोपी को जमानत पर रिहा होने से रोक दें।
