Supreme Court finds that the wife had treated the husband with cruelty|सुप्रीम कोर्ट ने पाया कि पत्नी ने पति के साथ क्रूरता किया

The appellant (the petitioner in the lower court) is seeking a divorce from his second wife, the respondent, on the grounds of cruelty. 

The appellant claims that the respondent did not like him showing love and affection to his children from his first marriage,and that she would scratch his face, pick fights with him and the children, and attempted to commit suicide. 

The respondent denies the allegations of cruelty, and claims that it was the appellant who treated her with cruelty, including allegations of having an illicit relationship with a woman named Komalavally. 

The lower court dismissed the petitioner's case. The appellant argues that the lower court did not correctly appreciate the evidence and documents, and failed to draw the proper inference from the evidence presented. 

The appellate court after reviewing the evidence finds that the wife had treated the husband with cruelty and allows the appeal.

अपीलकर्ता (निचली अदालत में याचिकाकर्ता) अपनी दूसरी पत्नी, प्रतिवादी से क्रूरता के आधार पर तलाक की मांग कर रहा है।

अपीलकर्ता का दावा है कि प्रतिवादी को उसका अपनी पहली शादी से अपने बच्चों के लिए प्यार और स्नेह दिखाना पसंद नहीं था, और वह उसका चेहरा खुजलाती थी, उससे और बच्चों से लड़ती थी, और आत्महत्या करने का प्रयास करती थी।

प्रतिवादी क्रूरता के आरोपों से इनकार करती है, और दावा करती है कि अपीलकर्ता ने उसके साथ क्रूरता का व्यवहार किया, जिसमें कोमलावल्ली नाम की एक महिला के साथ अवैध संबंध होने के आरोप भी शामिल हैं।

निचली अदालत ने याचिकाकर्ता का केस खारिज कर दिया। अपीलकर्ता का तर्क है कि निचली अदालत ने सबूतों और दस्तावेजों की सही ढंग से सराहना नहीं की और प्रस्तुत सबूतों से उचित निष्कर्ष निकालने में विफल रही।

अपीलीय अदालत ने सबूतों की समीक्षा करने के बाद पाया कि पत्नी ने पति के साथ क्रूरता का व्यवहार किया और अपील की अनुमति दी।
